We assess the situation, formally invite the other party, explain our neutral role and the process benefits, and many initially reluctant parties become willing once they understand. For mediation to begin, both must agree to participate. But LexResolve does the heavy lifting of invitation and persuasion — that's the difference.

Yes. The Memorandum of Understanding (MOU) we draft during mediation is a clear, detailed written summary of your agreement. To make it legally binding and enforceable: the MOU is reviewed by independent lawyers (Independent Legal Advice, or ILA); a lawyer formalizes it as a signed agreement, court order, or consent terms; once formalized, it's fully enforceable — you can take action through the court if the other party breaches it. This approach gives you professional mediation + clear written terms + the ability to formalize and enforce it. You control the cost by only paying lawyers for final review, not the entire process.

No. All LexResolve mediators are called to the bar, so you receive legal guidance and framework throughout the process. Many clients find this lawyer-led approach valuable for understanding their options and implications. Having an independent lawyer review the final agreement is optional. Many clients choose Independent Legal Advice (ILA) especially for property or complex financial matters — we coordinate this.

Yes. Most mediation is available virtually or in-person, depending on what works best for you and the matter. SafePath explicitly offers virtual participation as a safety and flexibility option.

Mediation is recommended when you want to resolve a dispute faster and less expensively than court, prefer a collaborative approach, want to preserve relationships, or need control over the outcome. Mediation is not recommended if there is active, severe domestic violence with ongoing safety risk (though SafePath may apply) or one party has no genuine willingness to negotiate. At intake, we assess whether mediation is suitable for your situation and will let you know if another process might serve you better.
